GENERAL SALES CONDITIONS (G.S.C) RRS 2024

These General Sales Conditions are agreed upon by RRS company, with its registered office located in the activity zone of Orthus, 34270 Sauteyrargues, hereinafter referred to as "The Seller," and by any natural or legal person making a purchase through its websites www.rrs-direct.com, www.rrs-direct.pro, or by any other means, hereinafter referred to as "the Buyer." The Buyer declares being of legal age or, if not, holding parental authorization and having the legal capacity to enter into contracts, thus allowing them to place an order with the Seller.

All visuals presented on the Seller's websites and catalogs are non-binding and provided for informational purposes.

For any questions regarding an online, distance, or in-store purchase, the Seller's customer service can be contacted at: 04 67 14 00 80 from 9 am to 6 pm, Monday to Friday, except on public holidays. The parties agree that their relationship will be exclusively governed by these General Sales

Conditions, which are accessible on the Seller's websites. No specific condition can, except with formal and written acceptance by the Seller, prevail over the G.S.C. These conditions may be subject to modifications, and it is understood that the applicable conditions are those in force on the websites at the date of purchase.

A - Commitment:

The sale is concluded upon partial or full payment of the order by our services. Any concluded sale entails the customer's acceptance to receive newsletters from RRS.

B - Order/Sale Modification:

Any modification or resolution of the order requested by the Buyer can only be considered if it is received in writing before the products are shipped. If the Seller does not accept the modification or resolution, the deposits made will not be refunded.

RRS reserves the right to suspend any Order or to cancel it, in the case where: The order is abnormal or abusive (Quantity, price) The order has an error (especially in case of non-payment, wrong address, buyer's error) In case of prolonged unavailability of ordered items; In case of modification of the Ordered Products by the suppliers, during the processing of the Order; In the context of a dispute with the Buyer. When the Order is suspended,

RRS resumes the execution of the Order upon resolution of the encountered difficulty. When processing the order involves additional unforeseen costs, and the cause of the difficulty is attributable to the Buyer, RRS may bill these costs to the Buyer (especially in case of delivery error due to a wrong or incomplete delivery address).

C - Prices:

Our prices correspond to the rate in force on the day of the sale. The prices listed in our pricelists and catalogs are established ex-factory. They are subject to change without notice. Prices are expressed in euros including all taxes. The Seller reserves the right to modify them in case of a VAT rate variation, and to cancel the order in case of a manifest error on the price, product, or discount.

D - Payment and Deadlines:

 1/ Cash Payment

 Our articles, goods, or services are payable in cash at the time of the order. Consequently, all orders will be shipped once the Buyer's full payment has been received by the Seller. All sums paid by the Seller are considered as deposits by the parties. If, however, exceptionally, the Seller has granted specific payment terms to the Buyer, the articles and goods are subject to a retention of title until the full payment of the price, fees, and associated services. No discount will be granted for cash payment or for early payment. In case of late payment compared to the due date, a late interest of 3% of the amount per month of delay and a lump sum indemnity of 20 € including taxes for recovery costs will be demanded. Accepted means of payment are cash, checks, bank transfer, credit card.

2/ Payment in 3x or 4x by Oney

 Payment of your order in 3 or 4 installments by CB from 100€ of purchases up to 3000€ with Oney Bank. Our partner Oney Bank offers a financing solution called 3x 4x Oney, which allows you to pay your purchases from 100€ to 3000€ in 3 or 4 installments with your credit card.

Conditions:

This offer is reserved for individuals (adult natural persons) residing in France and holders of a Visa and MasterCard credit card with a validity date greater than the chosen financing duration. Systematically authorized cards of the Electron, Maestro, Nickel types, etc., as well as e-cards, Indigo and American Express cards are not accepted.

Subscription Modalities:

After completing your order, you just need to click on the "3x 4x Oney payment by credit card" button. You then notify your electronic acceptance by checking the corresponding box. You acknowledge that the "double click" associated with checking the box on the awareness of the general conditions constitutes consent to contract and is an irrevocable and unreserved acceptance of the product's general conditions. Unless proven otherwise, the data recorded by Oney Bank constitute proof of all transactions between you and Oney Bank. If you request to benefit from a financing solution offered by Oney Bank, the information related to your order will be transmitted to Oney Bank, which will use it for the purpose of studying your request for the granting, management, and collection of credit. Oney Bank reserves the right to accept or refuse your 3x 4x Oney financing request. You have a withdrawal period of 14 days to renounce your credit.

Operation:

The payment in 3 or 4 installments by credit card allows you to settle the order made on our merchant site as follows - a mandatory down payment, debited on the day of the confirmation of the dispatch of your order corresponding to a third or a quarter of the order, to which are added fees corresponding to 1.45% of the total amount of the order for a 3 times and to 2.2% for a 4 times (within the limit of 15€ maximum for a 3 times payment and 30€ maximum for a 4 times payment); - two or three installments, each corresponding to a third or a quarter of the order, debited at 30 and 60 days after for the 3 times and at 30, 60, and 90 days after for the 4 times.

• The payment in 3 times from 100€ of purchase and up to 3000€ Example: For a purchase of 150€, down payment of 52.18€ then 2 installments of 50€. Credit over 2 months at a fixed APR of 19.31%. Financing cost: 2.18€ within the limit of 15€ maximum.
• The payment in 4 times from 100€ of purchase and up to 3000€ Example: For a purchase of 400€, down payment of 108.80€ then 3 installments of 100€. Credit over 3 months at a fixed APR of 19.61%. Financing cost: 8.80€ within the limit of 30€ maximum.

3/ RRS Gift Cards :

RRS gift cards are valid for 12 months.

E - Transfer of Risks:

The transfer of risks on the products occurs as soon as they are shipped from the Seller's warehouse. This results in the goods traveling at the Buyer's risk.

F - Receipt of the Goods by the Buyer:

Upon their arrival at the place of destination, it is the Buyer's responsibility to acknowledge their condition before taking possession under their responsibility. It is the Buyer's responsibility to check the condition of the products in the presence of the carrier to ensure the absence of damage. In case of anomaly (damaged packaging, missing, damaged products) the Buyer must precisely mention the condition of the package justifying their refusal on the delivery document, have these reservations signed by the carrier, and report the facts to the Seller within 72 hours.

The Seller informs the Buyer that the parts intended for the adaptation of vehicles may have characteristics such that they make their circulation prohibited on roads open to public traffic to the extent that they modify the characteristics of the vehicles as described in the reception report issued by the mining service: noise, pollution, maximum speed, etc.

All items offered by the Seller are intended for motorsport and competition. They are not subject to any specific contractual warranty due to their particular conditions of use. These items may cancel the original manufacturer's warranty of the vehicle on which they are used. Moreover, the Seller strongly recommends the Buyer to call upon a professional mechanic to install the items according to the rules of art and in compliance with the regulations in force.

G - Return of Goods:

The Buyer has a period of 14 clear days from the delivery of their order to return the product, in its original packaging, to the Seller for exchange or refund, without penalties except for the return and reshipment fees. All requests must be made by email: sav@rrspro.com or by phone at 04.67.14.58.71, from Monday to Friday from 9 am to 5 pm except on public holidays. If this period normally expires on a Saturday, Sunday, or public holiday, it is extended until the first following working day. The costs and risks of the return are always borne by the Buyer. Similarly, the Seller reserves the right to retain up to 20% of the price of the returned item for refurbishment or packaging fees. No return will be accepted after a period of 14 clear days following the delivery date.

The Buyer is informed that the right of withdrawal does not apply to Products:

 Customized according to the specifications of the Buyer or significantly modified from the standard model proposed by RRS. Products personalized by the Buyer via RRS's customization service are thus excluded from the scope of the Customer's right of withdrawal. Sealed that have been unsealed by the Customer after delivery and cannot be returned for hygiene reasons. For any refund request in the context of a right of withdrawal, the Buyer is informed that RRS will proceed to the refund of all returned items in good condition as well as the standard shipping costs. Additional shipping costs initially paid by the client (Express) will remain at the client's expense.

H- Warranty:

The Seller guarantees against hidden defects of the sold item. The Buyer has eight clear days from the discovery of the hidden defect to inform the Seller by registered letter with acknowledgment of receipt.

I - Retention of Title Clause:

In accordance with the law of May 12, 1980, n° 80.335, the Seller reserves the ownership of the products and goods, objects of the present debits, until the payment in full of the price, fees, and its accessories. In case of total or partial non-payment of the price at the due date for any reason whatsoever, by express agreement, the Seller reserves the right, without formalities, to physically take back possession of these products and goods at the expense, risks, and perils of the Buyer. In case of dispute, the Commercial Court of Montpellier is the only competent authority for sales to professionals.

J - Illustrations and Images:

The drawings, diagrams, images, photographs in our catalogs and website are solely intended to support the text and are in no way binding.

K - Use of Computer Data:

In the context of its activities, and in compliance with the legislation in France and in Europe, the Seller commits to ensuring the protection, confidentiality, and security of the personal data of its customers, and to respect their privacy. Therefore, the Seller commits to respecting the law n° 78-17 of January 6, 1978, relating to information technology, files, and freedoms, amended by the European Regulation 2016/679 of April 27, 2016, relating to the protection of personal data.
